Serviceniv\u00e5 och lotsf\u00f6rmedlingsomr\u00e5den<\/h4>\n\n\n\n<p>Lotsningstj\u00e4nster tillhandah\u00e5lls dygnet runt \u00e5rets alla dagar. Serviceniv\u00e5n m\u00e4ts i v\u00e4ntetid p\u00e5 lotsningstj\u00e4nsten. Vid m\u00e4tningen beaktas \u00e4ven l\u00e4mnandet av f\u00f6rhandsanm\u00e4lan i enlighet med avsnitt 4.2.1\u20134.2.4. I havsomr\u00e5den \u00e4r v\u00e4ntetiden h\u00f6gst tre (3) timmar och i Saimenomr\u00e5det h\u00f6gst sex (6) timmar.   <\/p>\n\n\n\n<p>Finnpilot Pilotage Ab tillhandah\u00e5ller lotsningstj\u00e4nster f\u00f6r alla fartyg som ska lotsas. Lotsningsresurserna dimensioneras enligt den regulj\u00e4ra trafiken. <\/p>\n\n\n\n<p>Lotsningstj\u00e4nster tillhandah\u00e5lls inom det lotspliktiga omr\u00e5det i Finland. I f\u00f6reskriften S<em>kyldighet att anlita lots och f\u00f6rfaranden relaterade till detta i Finlands vattenomr\u00e5de<\/em>, som utf\u00e4rdats med st\u00f6d av lotsningslagen (561\/2023), finns de farleder d\u00e4r lots b\u00f6r anlitas. D\u00e5 en s\u00e5dan farled eller en del av den \u00e4r ett alternativ till en tidigare lotsled eller en del av den, \u00e4r det den lotsande lotsen som fattar beslut om vilken farled eller del av denna som ska anv\u00e4ndas.  <\/p>\n\n\n\n<p>Fartyg, d\u00e4r den person som \u00e4r ansvarig f\u00f6r navigeringen och man\u00f6vreringen har ett Pilot Exemption Certificate (PEC-certifikat) som befriar fr\u00e5n lotsplikt, kan vid behov f\u00e5 ta del av lotsningstj\u00e4nsterna, men om det f\u00f6rekommer f\u00f6rdr\u00f6jningar i tillg\u00e5ngen till tj\u00e4nsterna har de inte r\u00e4tt till nedsatt lotsningsavgift enligt avsnitt 5.2. N\u00e4rmare anvisningar om tillg\u00e5ngen till lotsningstj\u00e4nster under den tid som assistansbegr\u00e4nsningar \u00e4r i kraft finns i bilaga 1.  <\/p>\n\n\n\n<p><em><strong>Kravenlighet vid arrangemangen f\u00f6r tagande och l\u00e4mnande av lots<\/strong><\/em><\/p>\n\n\n\n<p>F\u00f6r att lotsen ska kunna borda och l\u00e4mna fartyget p\u00e5 ett s\u00e4kert s\u00e4tt m\u00e5ste fartygets arrangemang f\u00f6r tagande och l\u00e4mnande av lots f\u00f6lja de internationella best\u00e4mmelserna. Lotsen bordar inte ett fartyg som inte har ett s\u00e4kert arrangemang f\u00f6r tagande av lots och l\u00e4mnar inte ett fartyg som inte har ett s\u00e4kert arrangemang f\u00f6r l\u00e4mnande av lots. N\u00e4rmare information om situationer d\u00e4r arrangemangen f\u00f6r tagande och l\u00e4mnande av lots inte \u00f6verensst\u00e4mmer med kraven finns i bilaga 2.  <\/p>\n\n\n\n<p><strong><em>Anv\u00e4ndning av str\u00e5lkastare i Saimen<\/em><\/strong><\/p>\n\n\n\n<p>N\u00e4rmare information om anv\u00e4ndning av och tillg\u00e5ng till str\u00e5lkastare p\u00e5 fartyg som r\u00f6r sig i Saima kanal och Saimens sj\u00f6omr\u00e5de finns i bilaga 3.<\/p>\n\n\n\n<p><strong><em>R\u00f6kning p\u00e5 det lotsade fartygets kommandobrygga<\/em><\/strong><\/p>\n\n\n\n<p>Enligt Finlands lag \u00e4r tobaksr\u00f6kning f\u00f6rbjuden i s\u00e5dana lokaler i byggnader, i kommunikationsmedel och p\u00e5 motsvarande platser som \u00e4r tillg\u00e4ngliga f\u00f6r allm\u00e4nheten eller anst\u00e4llda eller f\u00f6r kunder f\u00f6r tillhandah\u00e5llande av tj\u00e4nster som producerats i n\u00e4ringsverksamhet eller offentliga tj\u00e4nster. Anvisningen ska till\u00e4mpas oberoende av vilken referensniv\u00e5 som anv\u00e4nds i sj\u00f6kortet. I anvisningen ers\u00e4tts begreppet leddjupg\u00e5ende med begreppet dimensionerat djupg\u00e5ende. Med dimensionerat djupg\u00e5ende avses det planerade djupg\u00e5ende som det dimensionerande fartyget i normala f\u00f6rh\u00e5llanden kan anv\u00e4nda p\u00e5 farleden, men som man kan avvika fr\u00e5n om omst\u00e4ndigheterna till\u00e5ter.   <\/p>\n\n\n\n<p>En anm\u00e4lan om anv\u00e4ndning av farleden ska l\u00e4mnas enligt lagen om fartygstrafikservice eller en f\u00f6reskrift som utf\u00e4rdats med st\u00f6d av den eller enligt n\u00e5gon annan myndighetsanvisning. Asiakas kuitenkin vastaa siit\u00e4, ett\u00e4 aluksen y\u00f6aikaiset suunnitelmat sek\u00e4 muut seikat, joilla voi olla vaikutusta aluksen l\u00e4ht\u00f6aikaan, ilmoitetaan luotsinv\u00e4litykseen viimeist\u00e4\u00e4n iltap\u00e4ivityksen yhteydess\u00e4. <\/p>\n\n\n\n<p>Nattetid kl. 24.00\u201306.00 beh\u00f6ver f\u00f6rhandsanm\u00e4lan inte uppdateras, s\u00e5vida det inte gjorts \u00e4ndringar i fartygets tidtabell eller i andra uppgifter som p\u00e5verkar lotsningen. F\u00f6r trafik inom Saimen ska fartyget eller fartygets ombud g\u00f6ra en lotsbest\u00e4llning 14 dygn f\u00f6re \u00f6nskad tidpunkt f\u00f6r lotsningens b\u00f6rjan. <\/p>\n\n\n\n<p><strong><em>Anv\u00e4ndning av n\u00e5got annat st\u00e4lle \u00e4n en officiell lotsplats<\/em><\/strong><\/p>\n\n\n\n<p>Om ett fartyg \u00f6nskar lots till n\u00e5got annat st\u00e4lle \u00e4n en officiell lotsplats eller en hamn (t.ex. till en ankarplats), ska fartygets ombud eller fartyget informera lotsf\u00f6rmedlingen om sin plan per e-post en vecka i f\u00f6rv\u00e4g. Finnpilot Pilotage Ab bed\u00f6mer om den f\u00f6reslagna planen kan genomf\u00f6ras och f\u00f6rbeh\u00e5ller sig r\u00e4tten att godk\u00e4nna eller f\u00f6rkasta planen. Utifr\u00e5n f\u00f6rhandsuppgifterna anvisar Finnpilot personalresurser f\u00f6r olika lotsningar via lotsf\u00f6rmedlingen.  <\/p>\n\n\n\n<p>Om kunden underl\u00e5ter att l\u00e4mna ovann\u00e4mnda uppgifter (avsnitt 4.2.1\u20134.2.4) p\u00e5 det s\u00e4tt som f\u00f6reskrivs i dessa tj\u00e4nstevillkor eller inom den utsatta tiden, \u00e4r Finnpilot inte skyldig att tillhandah\u00e5lla lotsningstj\u00e4nsten inom den av kunden \u00f6nskade tidtabellen. Inom Finlands territorialvatten \u00e4r v\u00e4nteavgiften 500 euro f\u00f6r varje p\u00e5b\u00f6rjad timme som \u00f6verskrider den n\u00e4mnda timmen. P\u00e5 Saima kanal och Saima vattenomr\u00e5de \u00e4r v\u00e4nteavgiften 250 euro per p\u00e5b\u00f6rjad timme.   <\/p>\n\n\n\n<p>Lotsen kan p\u00e5 kundens beg\u00e4ran stanna ombord f\u00f6r att v\u00e4nta p\u00e5 n\u00e4sta lotsning eller p\u00e5 att f\u00e5 l\u00e4mna fartyget. \u00d6verenskommelse om att lotsen v\u00e4ntar ombord ska alltid ing\u00e5s p\u00e5 f\u00f6rhand. M\u00f6jligheten att v\u00e4nta kontrolleras hos lotsf\u00f6rmedlingen. Finnpilot beslutar fr\u00e5n fall till fall om lotsen kan v\u00e4nta ombord. Om lotsen p\u00e5 kundens beg\u00e4ran enligt en f\u00f6rhands\u00f6verenskommelse v\u00e4ntar ombord p\u00e5 fartyget, debiteras 250 euro f\u00f6r varje p\u00e5b\u00f6rjad timme. I priset ing\u00e5r lotsens resekostnader och dagtraktamenten.     <\/p>\n\n\n\n<p><em>Exempel p\u00e5 v\u00e4ntetid p\u00e5 kundens beg\u00e4ran: Man vet att lotsen, till exempel p\u00e5 grund av h\u00e5rd vind, inte kommer att kunna l\u00e4mna ett utg\u00e5ende fartyg vid lotsplatsen. I s\u00e5 fall kan Finnpilot och kunden sinsemellan komma \u00f6verens om att lotsen l\u00e4mnar fartyget antingen vid en s\u00e5dan finl\u00e4ndsk lotsplats d\u00e4r detta \u00e4r m\u00f6jligt med tanke p\u00e5 f\u00f6rh\u00e5llandena eller forts\u00e4tter med fartyget till f\u00f6ljande hamn. F\u00f6r denna v\u00e4ntan efter lotsning debiterar Finnpilot 250 euro f\u00f6r varje p\u00e5b\u00f6rjad timme.  <\/em><\/p>\n\n\n\n<p><em><strong>Avgift f\u00f6r \u00e4ndring av best\u00e4llning<\/strong><\/em><\/p>\n\n\n\n<p>Om det inte \u00e4r fr\u00e5ga om en avbokning av en best\u00e4llning och best\u00e4llaren eller best\u00e4llarens ombud \u00e4ndrar en bindande lotsbest\u00e4llning efter att den egentliga best\u00e4llningstiden g\u00e5tt ut, tar Finnpilot ut en avgift p\u00e5 500 euro f\u00f6r \u00e4ndring av best\u00e4llning inom Finlands territorialvatten. I Saima kanal och Saimens vattenomr\u00e5de \u00e4r avgiften f\u00f6r \u00e4ndring av best\u00e4llning 250 euro.   <\/p>\n\n\n\n<p>F\u00f6r tydlighetens skull ska best\u00e4llaren eller best\u00e4llarens ombud ange orsaken till \u00e4ndringen i faktureringsgrunden.<\/p>\n\n\n\n<p><strong><em>Annuleringsavgift<\/em><\/strong><\/p>\n\n\n\n<p>Om best\u00e4llaren eller best\u00e4llarens ombud avbokar lotsningen efter att best\u00e4llningstiden g\u00e5tt ut, tas det ut en annulleringsavgift av fartyget. Inom Finlands territorialvatten \u00e4r annulleringsavgiften 1 000 euro, i Saima kanal och Saimens vattenomr\u00e5de 500 euro.  <\/p>\n\n\n\n<p>F\u00f6r tydlighetens skull ska best\u00e4llaren eller best\u00e4llarens ombud ange orsaken till \u00e4ndringen i faktureringsgrunden.<\/p>\n\n\n\n<p><strong><em>H\u00f6jning av lotsningsavgiften<\/em><\/strong><\/p>\n\n\n\n<p>N\u00e4r lotsningen i enlighet med 22 \u00a7 i lotsningslagen eller p\u00e5 beg\u00e4ran utf\u00f6rs av tv\u00e5 lotsar, tas lotsningsavgiften ut h\u00f6jd med 75 procent.<\/p>\n\n\n\n<p><strong><em>Lotsningsavgift f\u00f6r fartygskombination och stockflotte<\/em><\/strong><\/p>\n\n\n\n<p>F\u00f6r bogserare, skjutbogserare och f\u00f6r fartyg eller anl\u00e4ggning som bogseras eller skjutbogseras liksom \u00e4ven f\u00f6r skjutbogserenheter tas en lotsningsavgift ut enligt kombinationens sammanlagda nettodr\u00e4ktighet. Separata best\u00e4mmelser om Finnpilots ansvar f\u00f6r lotsningen finns i lotsningslagen. Enligt lagen \u00e4r skadest\u00e5ndsansvaret f\u00f6r skador som uppst\u00e5r vid lotsning h\u00f6gst 100 000 euro per skadefall. Uppkomsten av skadest\u00e5ndsansvar f\u00f6ruts\u00e4tter att skadan har orsakats upps\u00e5tligen eller av grov oaktsamhet och med insikt att s\u00e5dana skador sannolikt skulle uppkomma.   <\/p>\n\n\n\n<p>Finnpilot ansvarar inte f\u00f6r direkta eller indirekta skador som orsakas av tillhandah\u00e5llandet av s\u00e5dana lotsningstj\u00e4nster som avses i dessa villkor.<\/p>\n\n\n\n<p>Finnpilot fakturerar den part som har best\u00e4llt lotsningen. Eventuella fakturareklamationer tas emot och behandlas i Finnpilots elektroniska system. Som befrielsegrund (Force Majeure) betraktas en exceptionell h\u00e4ndelse som Finnpilot inte har kunnat beakta, och som \u00e4r oberoende av Finnpilot eller vars p\u00e5verkan inte rimligen kan undvikas eller f\u00f6rhindras. F\u00f6r att vintertrafiken ska l\u00f6pa s\u00e5 s\u00e4kert och smidigt som m\u00f6jligt \u00e4r m\u00e5let med Transport- och kommunikationsverkets isklassf\u00f6reskrifter att de fartyg som trafikerar \u00d6stersj\u00f6n och deras bes\u00e4ttning ska ha tillr\u00e4ckliga f\u00f6ruts\u00e4ttningar f\u00f6r sj\u00e4lvst\u00e4ndig navigering i isf\u00f6rh\u00e5llanden.  <\/p>\n\n\n\n<p>Trafikledsverket har utarbetat anvisningar f\u00f6r vintersj\u00f6farten i samarbete med industrin, rederier, befraktare, sj\u00f6farare, isbrytare, lotsar och fartygstrafikservicen. Intressentgrupperna b\u00e4r sitt ansvar f\u00f6r Finlands vintersj\u00f6fart och str\u00e4var efter att ordna sina import- och exporttransporter p\u00e5 fartyg som \u00e4r moderna, har tillr\u00e4cklig maskineffekt, goda isg\u00e5ngegenskaper och framf\u00f6rs av en beh\u00f6rig bes\u00e4ttning. <\/p>\n\n\n\n<p>D\u00e5 isl\u00e4get f\u00f6rv\u00e4rras, begr\u00e4nsar Trafikledsverket isbrytarassistansen om detta kr\u00e4vs f\u00f6r att trygga s\u00e4kerheten och ett fungerande trafiksystem.<\/p>\n\n\n\n<p><strong><em>Lotsning under den tid som assistansbegr\u00e4nsningar \u00e4r i kraft<\/em><\/strong><\/p>\n\n\n\n<p>Enligt 23 \u00a7 i lotsningslagens ska lotsen v\u00e4gra eller avbryta en lotsning, om han eller hon anser att inledandet av resan eller en fortsatt resa skulle \u00e4ventyra s\u00e4kerheten f\u00f6r fartyget, de ombordvarande, den \u00f6vriga sj\u00f6trafiken eller milj\u00f6n. Lotsen kan med h\u00e4nvisning till ovann\u00e4mnda orsaker v\u00e4gra att lotsa ett fartyg som i vinterf\u00f6rh\u00e5llanden inte har en isklass som uppfyller kraven i assistansbegr\u00e4nsningarna eller om fartyget inte uppfyller dessa till f\u00f6ljd av till exempel sitt djupg\u00e5ende eller om fartyget inte har av Trafikledsverket beviljad dispens f\u00f6r assistans. <\/p>\n\n\n\n<p>F\u00f6r att f\u00e5 lotsningstj\u00e4nster ska fartyg som inte \u00e4r ber\u00e4ttigade till isbrytarassistans, till lotsningsbolaget framl\u00e4gga en assistansplan med vilken man kan s\u00e4kerst\u00e4lla trygg navigering i is. Assistansplanen ska inneh\u00e5lla en plan f\u00f6r fartygets framfart som beaktar det r\u00e5dande isl\u00e4get i omr\u00e5det (med assistansbegr\u00e4nsningar), egenskaperna hos den bogserb\u00e5t som ska anv\u00e4ndas f\u00f6r assistansen och eventuella begr\u00e4nsningar i trafikomr\u00e5det. Vid bed\u00f6mningen av assistansplanen f\u00f6ruts\u00e4tter Finnpilot att den utrustning som \u00e4r n\u00f6dv\u00e4ndig f\u00f6r fartygets man\u00f6vrering och energiproduktion fungerar n\u00e4r lotsningen inleds och att fartygets skrov, maskineffekt, utrustning och bes\u00e4ttning \u00e4r s\u00e5dana att s\u00e4kerheten inte \u00e4ventyras i de r\u00e5dande isf\u00f6rh\u00e5llandena. The purpose of this amendment is to provide the basic safety requirements for the pilots, pilot boats and the shipmasters to be followed. If the described safe practice in the boarding and landing of pilots by pilot boat is not followed, the pilotage service cannot be provided. However, these requirements on safe operating procedures can be adapted to suit particular locations or circumstances.   <\/p>\n\n\n\n<p>In adverse or difficult conditions where there is significant risk to personnel or the pilot boat, the pilot boat operator will make the eventual decision whether to place the pilot boat alongside the ship or to abort the transfer. If conditions during the pilot embarkation are such that they create any risk of injury the attempt shall be abandoned. If the pilot considers the embarkation unsafe for any reason, he or she will not embark the ship until the risk factors have ceased to exist.  <\/p>\n\n\n\n<p>If the pilot ladder rigged on the vessel appears to be or is, clearly damaged, unsafe or rigged incorrectly, the pilot shall request the ship to replace or re-rig the ladder; or if necessary, refuse to board or disembark the vessel until a safe means of embarkation\/disembarkation is provided. The pilot shall report formally all cases of pilot ladder nonconformity according to the company procedure and the report is further submitted to the Finnish Transport and Communications Agency Traficom (Port State Control authority in Finland). <\/p>\n\n\n\n<p>Ships have a duty to rig their pilot ladders in accordance with The International Convention for Safety of Life at Sea (SOLAS) regulation \/ 23 and IMO resolution A 1045(27) as amended. A copy of the poster showing IMO requirements and IMPA recommendations \u2013 \u201cRequired Boarding Arrangements for PILOT\u201d is included as an annex to this document. <\/p>\n\n\n\n<p>Pilot transfer operations are not undertaken on ships that do not fully comply with transfer arrangements described above.<\/p>\n\n\n\n<p>The Pilot shall not embark if there is nobody at the top of the ladder.<\/p>\n\n\n\n<p>The ladder should be rigged and secured at the ship\u2019s side or side door as near midships as practical, and on the parallel body of the ship, clear of all overboard discharges. The ladder has to be located so that the pilot boat can lean against the parallel mid-body of the ship from the whole of its length. All steps of the ladder must rest firmly against the ship\u2019s side.
